NR12 FITNESS) PARTICIPANT AGREEMENT WAIVER AND RELEASE OF LIABILITY
We care about all participants who use this facility. We have taken all necessary precautions to ensure the facility is safe for use during manned and unmanned hours.
In consideration of NR12 FITNESS and/or equipment to enable me to participate in the Fitness Activities, I agree to the following:
Risks (1) I fully understand and acknowledge that;
(a) risks and dangers exist in my use of NR12 FITNESS equipment and participation in NR12 FITNESS
(b) my participation in such activities and/or use of such equipment may result in injury to the body, blindness, heat stroke, heart attack, death or any other ailments that could cause serious injury or disability;
(c) these risks and dangers may be caused by the negligence of the participants, the negligence of others, accidents, breaches of contact, the forces of nature or other causes, and
(d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and responsibility for any losses/accidents/injuries/damages to myself and/or the facility or equipment provided.
Abuse of membership (2) I fully understand and acknowledge the following measures, to which if abused, will result in my membership at NR12 FITNESS being reviewed and potentially terminated;
(e) allowing non-members to gain access to the club via opening entry doors for them
(f) Insufficient payments/expired memberships will inhibit restricted access
(g) negligence towards health and safety measures set in place
(h) CCTV is fully operational 24 hours a day for your safety and security whilst on the premises, during manned and unmanned gym hours. Tampering with such equipment is completely forbidden.
(i) Negligent behaviour/violence towards other members/staff/equipment
(j) Stealing or removing equipment from the gym floor
CANCELLATIONS & REFUNDS All membership cancellations require a 90 day written notice period
All class cancellations should be made within 4 hours of the class start time otherwise we will be unable to offer a refund and you will be charged as per our Cancellations & Refund Policy
Pre paid memberships including annuals and any other membership deals are non refundable.

Unmanned Implications (3) I fully understand the following guidelines apply when the facilities unmanned;
(k) access to changing rooms/showers/lockers will be restricted in the purpose of safety.
(l) access to the drinks fridge or other goods will be restricted.
(m) entry through the main access door only. Fire doors in the facility will be functional if required in an emergency
I, on behalf of myself’, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify NR12 FITNESS and its owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of service or otherwise which may arise out of my use of NR12 FITNESS equipment or my participation in NR12 FITNESS Activities. I specially understand the future of negligent acts or other conduct by the owners, agents, officers or employees of NR12 FITNESS.
I HAVE READ THE ABOVE WAIVER/RELEASE AND BY USING THIS SOFTWARE AND ATTENDING CLASSES IT AGREES IT IS MY INTENTION TO EXEMPT AND RELIEVE NR12 FITNESS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
